1. Contract conclusion / booking
Your registration is a binding offer to enter into a contract, including our contract and the conditions which you accept. The contract becomes binding for us after we confirm your registration in writing or by e-mail. The confirmation is usually sent by email. If necessary, this can be done by fax or mail. This is usually done immediately unless our contractual partners have any further questions. The new FAGG generally applies to remote sales and contracts made off-premises between businesses and consumers. However, services in the field of accommodation, motor vehicle rental, and leisure activities under section 18 (1) article 10 are expressly excluded from the right of withdrawal under the FAGG if a specific point in time or period is provided for the performance of the contract.
The photographic material on our website and the content of the registration confirmation are decisive for our services. The images on the website are mere examples of equipment and may vary depending on the individual taste of the owners. All "distances" are to be considered as approximate information and should only give you an approximate impression of the surroundings of the property. It is important for us that many of our buildings are outside. Therefore, spiders, ants, mosquitoes, flies, ear forceps and mice that do not present a defect may appear. Information in local or domestic brochures and local conditions that do not affect the premises for accommodation is not a part of the contract, no liability is accepted. The facilities described before and after the season, such as sports schools, restaurants, etc., may not be open. Booking offices act only as agents for concluding a contract with us. Their promises or additional agreements become binding only if we have confirmed them in writing.
3.1 Advance payment and final payment
Upon receipt of the booking confirmation / invoice, a deposit of 30% of the price is payable immediately. The remaining amount becomes due 4 weeks before the start of the rental, step by step, against sending documents / vouchers. Along with your documents, you will receive a voucher with the telephone number and address of the key holder and other useful information. In case of late payment, we are entitled to withdraw from the contract with an 8-day grace period. If the price of the reservation has not been paid in full by the beginning of the contractually agreed rental period, the contract will be terminated. The corresponding cancellation fees are required according to point 8 of these conditions as compensation. In case of last-minute offers or reservations up to 4 weeks before arrival, the price for the trip should be paid within 5 working days.
3.2 Change of fee
WARNING! Changes to dates or reservation in another facility can be made only if the cancellation or the new reservation is made 57 days in advance (see item 8 concerning fees). Reduction to a lower / cheaper category of persons is no longer possible 57 days in advance.
3.3 Additional costs
For individual buildings, the fees listed in the section "Additional costs" are not included in the price and must be paid on-site and directly to the owner of the building. In the case of special events, incidental costs must be paid in full and are excluded from discounts.
Upon accepting the property, the keyholder may require a deposit, which is intended to offset additional costs, etc. You assume the obligation to handle the leased property and the inventory in it carefully and carefully. You shall report any damage you cause immediately. You are responsible for the accompanying persons, including minors. The deposit will be refunded upon proper return of the rented property and compensation for additional costs.
4. Occupancy of the leased property
The residential units shall not be occupied by more than the number of people stated on the website unless there is written approval of additional people. Children are also considered a person. We can refuse excess people. Any damage or disadvantages resulting from rejection are to be borne by the customer without exception. If we confirm the occupancy of more people than stated on the website in writing, it must generally be expected that there will be no additional beds or corresponding apartment furnishings.
5. Arrival and departure
You can usually rent a property from 15:00 on the day of arrival. If people use local public transport for arrival, you must follow their opening hours, a full or partial refund of the price paid is not possible. In any case, the rented property must be kept clean. As a rule, you must leave the rented premises by 10:00 on the day of departure.
Pets are not generally allowed - the property description provides information. Pets must be mentioned in the registration.
7. Changes in services and prices
Information on the website is binding for the organizer, except for item 2. We reserve the right to correct any errors and major mistakes in the calculation. Naturally, you will be notified about this before the reservation. Any deviations of each service from the content of the contract after being made, that did not result from out bad faith, are allowed, when of small scope and adequate scope. In case the reserved property cannot be accessed for any unforeseen reason, we have the right to withdraw from this contract and cancel the reservation. However, we will of course try to offer a suitable substitution, but we are not obligated to do so.
8. In case of withdrawal from the contract, a cancellation fee is charged
You can withdraw from the contract at any time before the start of the rental period by making a written statement and paying the cancellation fee.
In case of cancellation we charge:
Up to 30 days before the start of the rental: for free
From 30 days before the start of the rental: 50%
From 14 days before the start of the rental: 100%
of the rental plus cancellation fee 45 €.
The cancellation statement, change of reservation, and changes will not take effect until the day after they are sent to us in writing. Statements received outside of our business hours are not considered accepted until the beginning of the next business day.
Of course, you may reserve the right to provide evidence of lower expenses on our part or lower damages we incur.
8.1 The customer does not arrive on time
If the customer does not embark on the trip at the agreed time, the customer will not embark. In such a case, he loses all rights to performance or to a refund of the rental price or parts thereof.
9. Cancellation Insurance
Please note that our services do not include any insurance. We recommend securing cancellation insurance together with the booking. We are happy to help you with this.
10. Service interruptions
If the service is not performed or is performed incorrectly, you are entitled to a warranty refund. However, you represent that you agree that instead of your right to transfer or reduce the price, we will provide a flawless service or improve the defective service within a reasonable time. Report any complaints or defects immediately to 00 43 (0) 676 3961477. This is the only way to rectify any defects immediately. Claims must be made against us within one month after the contractually agreed end of the rental period.
In the event of interruptions of services beyond our control, such as wars, strikes, lockouts, riots, epidemics, sovereign interventions, natural disasters, etc., as well as interruptions of services in the field of public supply and disposal facilities (e.g. water, electricity and other utilities) no liability will be accepted, especially if these disturbances are caused by force majeure or local climatic conditions.
You can only request a reduction in the price of the reservation or compensation if it is proven that you have immediately reported the defect to us or the responsible service provider, and if you are asked for a remedy and the services have not been provided following the contract.
12. Termination of contract
You may terminate the contract if no corrective action has been taken within a reasonable time and, as a result, the partial defaults significantly impair the use of the leased property. However, you must then pay the part of the agreed booking price that applies to the services you have used.
13. Duty to cooperate
You are required to cooperate in the event of a service disruption within the framework of legal provisions to prevent possible damage or to keep it at a low level. If you do not fulfil these obligations through your fault, you are not entitled to a price reduction or damages. If you do not make an immediate complaint, the agreed remedy will be withdrawn and the right to compensation (reduction, compensation) for all other damages that would not have occurred if they had been reported immediately would be reduced or terminated.
Our liability is excluded in the event of slight negligence.
15. Ineffectiveness of individual provisions
The ineffectiveness of individual provisions of the contract does not result in the ineffectiveness of the entire contract. The same applies to the conditions listed here.
